Terms of Use
PDF Secure Scan app · Provided by Appex s.r.o. · Last updated 9 October 2026
These Terms of Use ("Terms") govern your access to and use of the PDF Secure Scan mobile application, its content, features, and related functionality (together, the "App" or the "Service"). These Terms also serve as the end user licence agreement for the App.
The App is provided by Appex s.r.o., a company incorporated and operating under the laws of Slovakia, with its registered address at Vojvodská 3663/12, 040 01 Košice, Slovakia ("Appex", "we", "us", or "our").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, you must not use the App.
Please also read our Privacy Policy, which explains how the App handles information.
The App works entirely on your device. Your scans, documents, and PDFs are created and stored locally. We have no account system, and we never receive, store, or have access to your documents.
1. What the App is
PDF Secure Scan lets you use your device camera to scan pages, process the resulting images on the device, organise them into documents, store them in an encrypted local vault, and export or share them as PDF files.
The App is an offline document tool. It is not a certification service, notary service, archiving service, legal service, accounting service, or records-management service, and it does not make any document legally valid, certified, authenticated, or admissible for any official, legal, tax, or administrative purpose.
Scanning, cropping, contrast adjustment, and similar processing may change how a document looks compared with the original. You are responsible for checking that any scan or exported PDF is complete, legible, and faithful to the original before you rely on it or send it to anyone.
2. Licence to use the App
The App, including its software, design, interface, text, graphics, logos, features, and other materials, is owned by or licensed to Appex and is protected by intellectual property laws.
The App is licensed, not sold, to you. Appex grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App for your own personal or internal business purposes, in accordance with these Terms and with the usage rules of the app store or platform through which you obtained it. You do not acquire any ownership rights in the App. Appex reserves all rights in and to the App that are not expressly granted to you under these Terms.
Your licence is limited to devices that you own or control, except that the App may also be accessed and used by other accounts associated with you through a family sharing or volume purchasing feature offered by the app store, where that feature is available. Except where the applicable app store or platform usage rules permit it, you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, sublicense, sell, lease, rent, or lend the App, and if you sell or otherwise pass on a device to another person, you must remove the App from that device first.
These Terms also govern any content, materials, or services accessible from or purchased within the App, as well as any update or upgrade provided by Appex that replaces or supplements the App, unless that update or upgrade is accompanied by separate terms.
You may not copy (except as permitted by this licence and by the applicable app store or platform usage rules), modify, distribute, reverse-engineer, disassemble, decompile, attempt to derive the source code of, or create derivative works from the App, any update, or any part of it, except as and only to the extent that such a restriction is prohibited by applicable law, or to the extent permitted by the licensing terms governing any open-source components included with the App.
3. Your documents are your responsibility
You are solely responsible for the documents, images, and files you create, import, store, export, or share using the App, and for having the right to scan, copy, store, and share them.
Because the App stores everything locally and we operate no servers, we cannot see, retrieve, restore, or recover your documents in any circumstances.
The App stores documents in an encrypted vault on your device. The encryption key is generated on your device and kept in the platform key store (Android Keystore, iOS Keychain). It is never sent to us or to anyone else. On Android, the App is excluded from system and cloud backup, so neither your documents nor the key are ever included in a backup. On iPhone and iPad, an encrypted device backup can include both the encrypted vault and the key, so a device restored from such a backup can open your documents again; that backup is between you and Apple, and we have no access to it.
This means your documents become permanently unreadable if the key is lost — for example if you uninstall the App, reset or wipe the device, lose or damage the device, or move to or restore a device without an encrypted backup that contains the key store. On Android this happens on every uninstall, because nothing is backed up. There is no recovery mechanism, no password reset, and no copy held by us or by anyone else.
You are solely responsible for keeping your own backups of anything you need to preserve, by exporting the documents you care about to a location of your choice. To the maximum extent permitted by applicable law, Appex is not liable for any loss of documents, images, files, or data, however caused.
4. Device access and permissions
The App requires access to your device camera in order to scan pages. Camera images are processed on the device.
The App may ask for other device permissions where a feature you use requires them, for example to save or share a file. You can grant or refuse permissions in your device settings; refusing a permission may make the related feature unavailable.
You must not use the camera or any other device feature through the App in a way that breaches the law or the rights of other people, including recording or photographing people, places, or documents where you are not permitted to do so.
5. Acceptable use
You agree not to:
- use the App for unlawful, harmful, fraudulent, or misleading purposes;
- scan, copy, store, or share documents that you do not have the right to scan, copy, store, or share;
- use the App's image processing, editing, or export features to alter a document so as to misrepresent its content, or to create a forged, falsified, or deceptive document;
- present a scan or exported PDF as a certified, notarised, or officially authenticated copy;
- infringe the intellectual property, privacy, confidentiality, or other rights of any person;
- interfere with or disrupt the operation, security, or integrity of the App;
- reverse engineer, copy, modify, scrape, or commercially exploit the App except as permitted by these Terms or by applicable law;
- use the App in a way that may harm Appex, other users, or third parties.
6. Paid features
Some features of the App may require payment, subscription, or in-app purchase. Where they do, the price, the billing period, and what is included are shown in the App before you confirm the purchase.
Payments, renewals, cancellations, and refunds are processed by the Apple App Store, Google Play, or another payment provider, and their terms and policies apply in addition to these Terms. We do not receive or store your payment card details.
Payment is charged to your App Store or Google Play account when you confirm the purchase. A subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period; your account is charged for the renewal within the 24 hours before that period ends. You can manage or cancel a subscription in your app store account settings at any time after purchase. A one-time (lifetime) purchase is charged once and never renews.
Except where required by applicable law or by the rules of the relevant app store or payment provider, all payments are non-refundable.
In particular, we do not provide refunds, credits, or partial refunds for a subscription period that has already started, for a period during which you chose not to use the App, for features you did not use, or where your access ends because you or we terminate it under section 12.
We do not process payments ourselves and therefore cannot issue refunds. Any refund request for a purchase made through an app store must be submitted to that app store, which decides it at its own discretion under its own policies.
Right of withdrawal for EEA consumers
If you are a consumer located in the European Economic Area, you may have a legal right to withdraw from a digital service contract within 14 days, subject to applicable legal rules and exceptions. Where you request immediate access to digital content or digital services during the withdrawal period, you may be asked to consent to immediate performance and acknowledge that your withdrawal right may be affected once the digital content or service is provided. Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.
7. Sharing, exporting, and third-party services
When you choose to share, send, export, print, or open a document produced by the App, it leaves the App and is handed to the destination you select — for example an email client, messaging app, cloud storage service, printer, or another application on your device.
From that moment, the handling of that document is governed by the terms and privacy policies of the service, application, or device you sent it to. We do not control those destinations, have no visibility into them, and are not responsible for their availability, security, content, acts, or omissions.
You are solely responsible for choosing an appropriate destination and for the consequences of sending a document to it, including where a document contains confidential or personal information.
8. App stores, devices, and platform providers
These Terms are concluded between you and Appex only. They are not concluded with, and do not create any obligation for, Apple, Google, or any other app store, platform, or device provider. Appex, and not the app store provider, is solely responsible for the App and its content.
Your use of the App is also subject to the usage rules, terms, and conditions of the app store or platform through which you obtained it — for the Apple App Store, the Apple Media Services Terms and Conditions, and for Google Play, the Google Play Terms of Service. Nothing in these Terms is intended to conflict with those usage rules, and where a conflict arises, those usage rules prevail for the App obtained through that store.
The app store provider is not responsible for the App, its content, maintenance, support, claims, or liability, except as required by its own terms or by applicable law.
Maintenance and support
Appex is solely responsible for providing any maintenance and support services for the App. The app store provider — including Apple in respect of the App obtained through the Apple App Store — has no obligation whatsoever to furnish any maintenance and support services with respect to the App. You can reach us using the contact details in section 17.
Warranty responsibility
Appex is solely responsible for any product warranties for the App, whether express or implied by law, to the extent they are not effectively disclaimed under sections 9 and 10.
If you obtained the App through the Apple App Store and the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Appex's sole responsibility.
Product and legal claims
Appex, and not the app store provider, is responsible for addressing any claim by you or by any third party relating to the App or to your possession and use of it, including but not limited to product liability claims, any claim that the App fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation. Such claims are governed by these Terms and by applicable law.
Nothing in these Terms limits Appex's liability to you beyond what is permitted by applicable law.
Intellectual property claims
In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, Appex, and not the app store provider, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
Third-party terms
You must comply with any applicable third-party terms when using the App, including the terms of your mobile network operator or data plan and the terms of any third-party service or application that you share documents with.
Legal compliance, export controls, and sanctions
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List and the U.S. Department of Commerce Denied Persons List or Entity List.
You may not use, export, or re-export the App except as authorised by the laws of the jurisdiction in which you obtained it and by any other applicable export control laws, including those of the United States and the European Union. You also agree not to use the App for any purpose prohibited by those laws, including the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.
Government end users
The App and its related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as those terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, they are licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights that are granted to all other end users under these Terms. Unpublished rights are reserved under the copyright laws of the United States.
Third-party beneficiaries
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right (and are deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. Google and any other app store or platform provider are likewise third-party beneficiaries of these Terms to the extent required by their applicable rules.
9. Disclaimer of warranties
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPEX DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, GUARANTEES, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES AND CONDITIONS OF ACCURACY, RELIABILITY, SUITABILITY, MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, SECURITY, QUIET ENJOYMENT, NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY APPEX OR BY AN AUTHORISED REPRESENTATIVE OF APPEX CREATES A WARRANTY. SHOULD THE APP PROVE DEFECTIVE, THEN TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND WITHOUT PREJUDICE TO YOUR MANDATORY CONSUMER RIGHTS, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
We do not warrant that:
- the App will meet your expectations or needs;
- a scan or exported PDF will be complete, legible, correctly oriented, or a faithful reproduction of the original;
- a document will be accepted by any authority, court, employer, bank, insurer, or other recipient;
- the App will be compatible with every device, camera, operating system, or file destination;
- the App will be uninterrupted, secure, or free of bugs, errors, or harmful components;
- documents stored in the App will remain accessible, or that any data can be recovered.
Nothing in these Terms excludes or limits any warranty, guarantee, or right that cannot be excluded under applicable law. Some jurisdictions do not allow the exclusion of implied warranties or limitations on the applicable statutory rights of a consumer, so the above exclusions and limitations may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPEX, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, SUPPLIERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, LOSSES, COSTS, EXPENSES, OR CLAIMS — INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF DOCUMENTS, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO:
- your access to, use of, or inability to use the App;
- any loss, corruption, or inaccessibility of documents, images, files, or the encryption key, including after uninstalling the App, resetting a device, or restoring a backup;
- any scan or exported PDF being incomplete, illegible, altered, or rejected by a recipient;
- any reliance you place on a document produced by the App;
- any document you share, send, export, or print, and anything that happens to it afterwards;
- any unauthorised access to your device or to documents stored on it;
- any third-party application, service, device, printer, or platform;
- any change, suspension, discontinuation, or unavailability of the App.
THIS LIMITATION APPLIES HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, CONSUMER LAW, WARRANTY, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, AND EVEN IF APPEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPEX'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF:
- the amount you paid for the App in the 12 months before the event giving rise to the claim; or
- EUR 50.
These limitations will apply even if a remedy provided under these Terms fails of its essential purpose.
Some jurisdictions do not allow certain exclusions or limitations of liability, including for personal injury or for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct, fraud, fraudulent misrepresentation, or other liability that applicable law does not allow to be excluded.
11. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Appex, its owners, directors, employees, contractors, affiliates, partners, suppliers, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use or misuse of the App;
- your violation of these Terms;
- the documents you scan, store, export, or share;
- your violation of any law or third-party right, including privacy, confidentiality, and intellectual property rights.
This indemnity does not apply where prohibited by applicable consumer law.
12. Availability, updates, and termination
We may modify, update, suspend, discontinue, limit, replace, or remove any part of the App at any time, including features, design, pricing, and technical requirements. We do not guarantee that the App will remain available, or that it will remain compatible with future operating system versions or devices.
The licence granted to you in section 2 is effective until terminated by you or by Appex. Your rights under it will terminate automatically, without notice, if you fail to comply with these Terms. You may terminate at any time by deleting the App from your devices.
Termination, suspension, or restriction of your access does not entitle you to any refund of amounts already paid, including for any remaining part of a subscription period, except where a refund is required by applicable law or is granted under the rules of the app store or payment provider that processed the payment. Refunds for purchases made through the Apple App Store or Google Play are decided and processed by Apple or Google, not by Appex.
Deleting the App removes its local data, including the encrypted vault and the encryption key. Export anything you want to keep before you do so.
Termination does not limit any rights or obligations that by their nature should continue, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law provisions.
13. Privacy
The App works offline and stores your documents only on your device. No server ever receives your documents, we have no account system, and we do not collect analytics, telemetry, crash reports, or advertising identifiers. The only records kept off the device are purchase records held by our payment processor and, on Android only, a pseudonymous count of the documents created in the current month, so that the free tier survives reinstalling the App.
Our Privacy Policy explains this in detail, including what stays on your device and what happens if you contact us for support.
14. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features, legal requirements, or operational changes. If changes are material, we may provide notice in the App, on our website, or by another appropriate method.
If you do not agree to updated Terms, you must stop using the App. Your continued use of the App after updated Terms become effective means that you accept them, except where additional consent is required by applicable law.
15. Governing law and jurisdiction
These Terms are governed by the laws of Slovakia, without regard to conflict of law rules, and the competent courts of Slovakia shall have jurisdiction.
If you are a consumer located in the European Economic Area (including Norway and Iceland), the United Kingdom, or Switzerland, the above choice of law does not deprive you of the protection of any mandatory consumer protection rules of the country in which you have your usual place of residence, and you may bring proceedings against us, and be sued by us, in the courts of that country. Nothing in these Terms limits those mandatory rights.
The United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to these Terms.
Where you obtained the App through an app store, the terms of that store may provide for a different governing law and forum for your separate relationship with the store provider. That does not change the law and forum applicable between you and Appex under this section.
Complaints and alternative dispute resolution
If you are not satisfied with the App, please contact us first using the details in section 17 so that we can try to resolve the matter directly.
If you are a consumer and you are not satisfied with the way we handled your complaint, you have the right to turn to an alternative dispute resolution body. For Slovakia, the competent body is the Slovak Trade Inspection Authority (Slovenská obchodná inšpekcia), Bajkalská 21/A, P.O. Box 29, 827 99 Bratislava 27, Slovakia — www.soi.sk — or another entity entered in the list of authorised alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic.
If you are a consumer resident in another country, you may also be able to use an alternative dispute resolution body available in your country of residence. Using alternative dispute resolution is voluntary and does not affect your right to bring proceedings in court.
16. General
Eligibility. You must have the legal capacity to enter into these Terms. If you are under 16, you may use the App only with the involvement and consent of a parent or guardian, and only where permitted by the law of your country.
Severability. If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. If we do not enforce any provision of these Terms, this does not mean that we waive our right to enforce it later.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, restructuring, change of control, or transfer of the App, in accordance with applicable law.
Entire agreement. These Terms, together with the Privacy Policy and any additional terms that apply to specific features or platforms, constitute the entire agreement between you and Appex regarding the App.
